Conditions of participation

The following conditions apply for taking part in the Facebook competition (‘competition’):

1. Organiser

The organiser of the competition is J.M. Gabler-Saliter Milchwerk GmbH & Co. KG, Kemptener Straße 6, 87634 Obergünzburg, info@saliter.de  (‘Gabler-Saliter’).

2. Participation

2.1.
The competition is open for entries from 28.01.2021 to 31.01.2021 (entry deadline).

2.2.
Open to persons aged 16 years and over who are resident or have their permanent address in Germany. Entrants are responsible for ensuring the accuracy of their information, in particular their email address. The entry must be made in the person’s own name. Entrants may not be employees of J.M. Gabler-Saliter Milchwerk GmbH & Co. KG, or involved in the development/running of the competition (e.g. officer, agent or supplier) nor a member of the family or household of any such person.

2.3.
In order to participate, please post on the Saliter Facebook page giving the correct number of hearts, and like the page.

2.4.
Gabler-Saliter reserves the right to disqualify from the competition any entrant who manipulates or attempts to manipulate the participation process or the course of the competition over the website or contravenes moral standards or otherwise unfairly or dishonestly seeks to influence the competition. Entry to the competition through prize draw organisations or automated services is not possible.

2.5.
Entry in the competition is free. Neither entry in the competition nor the chance of winning depend on the purchase of any goods or services, or subscription to a newsletter. Entry in the competition is, however, only open to those with an existing Facebook account (see https//facebook.com).

2.6.
All entrants who fulfil the eligibility criteria in the relevant competition period shall automatically be entered in the draw as long as they have not been deemed ineligible to enter. The prizes shall be awarded to the most original entries, which shall be determined when the entry deadline has passed.

2.7.
Three winners will be drawn from those who have given the correct answer, and these will each receive a bouquet of flowers which we will send via Fleurop. 

2.8.
The winners will be announced in a comment from Gabler-Saliter underneath the competition post (‘announcement of winners’). To claim a prize, winners must reply to the announcement of winners within five working days by emailing info@saliter.de. The reply must contain confirmation of acceptance of the prize and of the address given on the entry. If no reply is received, or one is received outside the time limit, the claim to a prize shall be forfeited without substitution.

3. Liability

3.1.
Gabler-Saliter accepts no liability for any breach of duty due to slight negligence, with the exception of breach of essential contractual obligations (so-called ‘cardinal obligations’), i.e. those legally necessary for fulfilment of the contract and which may generally be expected by the other party, and injury to a person’s life, limb or health. Gabler-Saliter’s liability in this respect is restricted to compensation for any foreseeable and direct injury typical for the respective goods or service.

3.2.
Should the prize have any material or legal defect, Gabler-Saliter shall not be obliged to compensate for any injury caused to the prize-winner unless Gabler-Saliter has fraudulently concealed the defect.

3.3.
Furthermore, the winner has no further claims against material or legal defects in the prize, nor any claim for compensation.

4. Data Privacy

4.1.
The data controller within the meaning of Art. 4, Para. 7 of the GDPR is J.M. Gabler-Saliter Milchwerk GmbH & Co. KG, Kemptener Straße 6, 87634 Obergünzburg. The company data privacy manager is Mr Peter Weigel, who can be contacted in writing at Ehrmann AG, A-Ehrmann-Straße 2, 87770 Oberschönegg or by email at datenschutz@ehrmann.de
As a responsible body within the meaning of the German Federal Data Protection Act, Gabler-Saliter shall always collect, process and use all personal data communicated to Gabler-Saliter in the course of this competition in accordance with the applicable regulations relating to privacy. Personal data is the following data provided by you in connection with the competition: first and last name, address, email address and telephone number if applicable. Gabler-Saliter shall not pass this personal data on to any third party, except in the case of service companies based in Germany which support Gabler-Saliter in running the competition (‘contract data processors’), which are likewise obliged to comply with the applicable legislation. Data shall be collected, processed and used solely for the purpose of operating the competition.

4.2.
You have the legal right to be provided with information free of charge, and have your personal data rectified, blocked or erased. To exercise this right, please contact: datenschutz@saliter.de

4.3.
Any request for your data to be erased before the end of the competition shall lead to the end of your participation, if the request for erasure precludes further participation. In this case, a win will no longer be possible.

4.4.
In addition, the (general) Gabler-Saliter privacy statement applies: this is available at https://www.saliter.de/datenschutz/. If the entry conditions for this competition differ from the (general) Gabler-Saliter privacy statement, then the competition entry conditions take precedence.

5. Other regulations/final provisions

5.1.
No right to take part in the competition or to win may be claimed. The prize is non-transferable and non-exchangeable. No cash payment is possible.

5.2.
Entering the competition implies acceptance of the conditions of the competition.

5.3.
If a single provision of the competition conditions should be invalid, or subsequently become legally invalid, the legal validity of the other conditions shall not be affected. In place of an invalid condition, a condition shall apply which is most nearly equivalent to the wishes of the parties within the framework of what is legally possible. This also applies to any contractual loophole.

5.4.
Changes to the competition conditions shall be made in writing. This also applies to a cancellation of the formal requirement itself.
